Town Board Minutes March 2015

is familiar; the procedure for establishing a fire protection district is fairly simple but it’s important to make one distinction in it.  1st the board has to hold a public hearing on the matter, if the board established that the fire protection district is in the best interest of the town then you have to adopt a resolution to that effect. Then subsequesnt to that resolution you have to adopt another resolution establishing the actual bounds of the district, the geographical boundaries as it’s mentioned in the actual law itself.  No properties within an incorporated village may be part of a fire protection district.  That’s the actual resolution to create the fire protection district then both of those resolutions, certified copies (resolutions) should be filed with the County Clerk and Audit & Control with the State Comptroller’s office within 10 days of the adoption.  Supervisor Volpe: this is the only other alternative correct?  Atty. Bavoso: yes. the 1st step is establishing a date and time for the public hearing.  This can be coordinated with the district dissolution.
