Town Board Meeting September 19th, 2022

The town board meeting of the Town of Mount Hope was held at the Mount Hope Town Hall on Sept. 19, 2022 at 7:30pm with the following present: Supervisor Matthew Howell, Councilman Brian Carey, Councilman Chris Furman, Councilman Jim Jennings, Councilwoman Amanda Davis and Town Clerk Kathleen Myers.
OFFICIALS PRESENT: Police Chief Rickard, Deputy Police Chief Maresca, Attorney David Bavoso.

Following the Pledge of Allegiance, Supervisor Howell called the meeting to order at 7:30pm.

MOTION TO ACCEPT THE PRIOR MEETING MINUTES:
MOTION offered Councilman Furman 2nd Councilwoman Davis to accept meeting minutes as presented from September 6, 2022. All in favor: Howell, Carey, Davis, Furman, Jennings; motion carried.

Town Clerk informed the board that the legal ad for the RESTORE NY grant will go in the paper on 9-22- 2022.

BOARD REPORTS:
Councilwoman Davis: OFD calls was 15. Planning board meets 9/21/2022.
Councilman Carey: OFD blood drive 9/21/2022, 1:30-7:30 at fire house. He has been working on the sign out front. One quote for a brand new one was $20,000. It should be inexpensive to fix this one.
Councilman Furman: FOTOS is holding a tricky tray on 9/24/2022, 12-4 at the old school.
Councilman Jennings: Village meeting on October 6; will have a public hearing to extend the terms for the village trustees from 2 years to 4 years. The local law to establish a code enforcement program for the V/O Otisville. Arbor day is 9/24/2022 at 10am at village park. Fire house renovations will be starting on Oct. 3rd; starting with the men’s room. Historical society had their tricky tray last weekend – good turnout.

POLICE DEPARTMENT:
Chief Rickard reported that 4 our of 6 of the FLOCK cameras are online. We got our 1st stolen license plate hit today. Councilman Jennings asked the Chief to explain what these cameras are used for. Chief: the cameras are traffic cameras. They take pictures of every car/object that passes them and records it. The little league had a complaint so they just gave me the information – I can now look at the license plate. I was trying to look it up but have no WIFI in here. If I had it, I could look it up and say this is the car – we have a picture of it. In NYS, they do not allow municipalities to do speed cameras. They have to be authorized by a special law.

VILLAGE OF OTISVILLE:
Trustee Lattimer reported that Arbor Day is coming up. The village attorney is seeking action against a village resident who has had many many years of violations. Bathroom renovations are underway as of 10/3. The OFD blood drive is on 9/21. He attended the tricky tray for the historical society. He thanked Nancie Craig for allowing his kids and Tyshawn’s kids to be honorary runners for the gifts.

MOTION TO APPROVE HIGHWAY BUDGET MODIFICATION:
MOTION offered Councilman Carey 2nd Councilman Furman to approve the budget modification as follows:
Increase scrap metal DB2650 by $182.85 &
Increase Machinery Equip Contr DB5130.4 by $182.85. (Payment from SIMS Metal Management for scrap metal.)
All in favor: Howell, Carey, Davis, Furman, Jennings; motion carried.

MOTION TO ACCEPT BID FOR THE ROLL OFF DUMPSTER SERVICE FOR FALL TRASH DAYS:
MOTION offered Councilman Jennings 2nd Councilman Furman to accept the bid from Middletown Carting as follows:

MOTION TO ACCEPT THE PROPOSED POLICE UNION CONTRACT AMENDMENTS:
MOTION offered Councilwoman Davis 2nd Councilman Carey to accept the proposed amendments to the police union contract. All in favor: Howell, Davis, Furman, Jennings, Carey; carried.

BUILDING DEPARTMENT REQUEST RE: SHORT TERM RENTALS:
Supervisor Howell: when we did our zoning code update a few years ago, we put in a provision for short term rentals similar to Airbnb. Those people that have these rentals will have to get a permit. This allows us to get an inspection of the dwelling to make sure it’s a safe occupancy for renters. We have the provisions in the code. We don’t have the fee schedule for the permits. There is a request for a permit. The building department recommends a base of $250 + $100/bedroom. It would have an annual renewal at ½ the original permit value. Councilman Carey: What is the fee if someone is caught? Supervisor: I don’t have that. Councilman Carey: (to the attorney) how do we prove that someone is using their house as an Airbnb if we don’t see cash or monetary….Attorney: find a listing online or you get reports from neighbors.

MOTION TO SET FEE SCHEDULE FOR BUILDING DEPARTMENT FOR AIRBNB PERMITS:
MOTION offered Councilman Carey 2nd Councilman Furman to set the fee for AIRBNB permits at $250.00 for the permit plus $100 per bedroom then half price each year thereafter. All in favor: Howell, Davis, Furman, Jennings, Carey; carried.

MOTION TO AUDIT THE CLAIMS:

2023 BUDGET MEETINGS:
Supervisor Howell reminded the board that the budget meetings will be on Sept. 20th and 28th at 6pm.

PUBLIC COMMENT:
Rich Rebman: About the Airbnb’s, didn’t the town pass a law about noise about 2-3 years ago? Bavoso: they did.
Brian Cutler explained there was an incident that occurred at the little league fields this past Saturday. A player hit a foul ball that went across the street. His son went across to get the ball. On his way back across the street he nearly was hit by a car. He’s lucky to be here. He doesn’t believe the car was speeding but there was no attempt to slow down. It could have been a very tragic situation. Something needs to be done to prevent this from happening again. Discussion on changing the speed limit on Finchville. Chief Rickard explained the process.
Brian Lattimer heard about this incident. He found a website: trafficsafety.store.com. There’s a real quick, easy install removeable temporary speed bumps for $100. If there was a set of 4 at each entrance to every avenue to the sports compound – that’s well within the range of saving one life.

Brian Lattimer cont.: Little league and football is there 7 months out of the year. To use the speed bumps from April to November then they can come up. Councilman Carey is concerned about the speed bumps with a 30MPH speed limit & possibly doing damage to a car. Mr. Lattimer asked for board permission to have a coin drop on 10/15/2022. He also brought this up at the village meeting. He spoke additionally about a new field. He understands it was brought up at the last meeting but met with hesitation. He asked if the town could help the little league to build it or give the little league permission to build it. Supervisor Howell: one of the items with regard to field location was across the street in the parking lot vs next to/behind the “c” field. The hang up on our end is the field across the street would be crossing for the bathroom, crossing for the concession stand. Do we really want to have the kids walking across the street 4/5/6 times during a game vs if it was on the same side of the street? Discussion. Mr. Lattimer noted that he will not be able to be here for our budget meetings but would some consideration in the budget to get more clay. He requested a guide rail to go all the way down to hopefully stop people from parking on the one side. Councilman Carey: correct me if I’m wrong, you had someone that was willing to install your field. Mr. Lattimer: Al Fusco generously was coming to assist us with an engineering plot. He got confused because last we talked; we were looking at across the street but nothing was final with you guys. With Al’s discussion with Dean – maybe a mis-communication – he said it was never a topic of putting it across the street it was always going to be behind the “C” field. Fencing funding for the new field was also a discussion in the past. Councilman Carey: Last we spoke, you were going to find someone to build the field. Lattimer: if you give us the go, we’ll get it done. Supervisor Howell: last meeting some of your colleagues were here and Dean had a set meeting with Fusco to go over some maps – they were looking for some information. Did they get together? Lattimer: Al got in touch with me and said he was still confused as to where it was going. After discussion: the board will meet with Dean on location for clarification.
Diane Loeven: Hometown Helpers will be having an orientation within 3-4 weeks. If anyone is interested, please send them our way. Mount Hope seniors will be going on a trip on 10/3. Also, the locks on the handicap entrance at the senior center need adjusting.
Brian Lattimer: reminded everyone of the library vote on 10/18.

MOTION TO APPROVE LITTLE LEAGUE REQUEST FOR COIN DROP:
MOTION offered Councilman Furman 2nd Councilman Carey to approve the coin drop for the Little League on 10/15/2022 from 11am -4pm at the intersection of Finchville Tpk and Mount Hope Avenue. All in favor: Howell, Carey, Jennings, Davis, Furman; carried.

BOARD COMMENTS:
Councilman Carey: the town newsletter will be going out soon. There is a full page on the library vote. Please vote on 10/18. He will have more information to come for the TRUNK or TREAT on Halloween. He’s been in touch with Rev. Farley to do this in conjunction with the church.
