Town Board Meeting October 18th, 2021

The town board meeting of the Town Board of the Town of Mount Hope was held at Town Hall at 1706 Route 211 West, Otisville, NY on October 18, 2021 at 7:30pm with the following present: Supervisor Chad Volpe, Councilman Matt Howell, Councilman Chris Furman, Councilman Brian Carey, Councilman Jim Jennings & Town Clerk Kathleen Myers.

OFFICIALS PRESENT: Highway Supt. Hassenmayer, Dep. Chief Maresca & Att’y Bill Bavoso.

Following the Pledge of Allegiance, Supervisor Volpe called the meeting to order.

MOTION TO ACCEPT THE PRIOR MEETING MINUTES:
MOTION offered Councilman Furman 2nd Councilman Howell that the minutes of the 10-4-2021 meeting are approved as presented. All in favor: Carey, Howell, Jennings, Volpe, Furman; carried.

BOARD REPORTS:
Councilman Howell noted the Veteran’s Day parade & celebration will be Nov. 13 starting 11AM. It will end at the village park. Update on the COVID funds/American rescue relief fund – HVAC at police building. Engineers office is still prepping the RFP for this. He added that 12/2/2021 is the tree lighting at the youth center building. Santa will be a guest.
Councilman Carey: Little league coin drop on 10/23/2021 from 12-5 on Finchville Turnpike. Little league would like to maybe switch to clay in sand instead of just clay. Clay sand mixture helps with drainage. They would also like to know if the town would be willing to make another ball field at the park. He invited them to a board meeting. The trunk & treat is on 10/31/2021 in the parking field next to Doctor Roeder.
Councilman Furman attended the library meeting with Matt & Lance from the village board. He wasn’t impressed. This week is bus safety week. Use caution. He spoke re: broken couch at the youth center. It cannot be repaired. It should go to surplus/destroy.
Councilman Jennings reported the village meeting will be 10/21 at 7pm. The planning board meeting is 10/20 at 7pm. The Otisville Lions Club will be hosting with the Otisville fire department the Halloween party on 10-31-2021 at the fire house from 6-9pm. He spoke with Mike Romano and everything ok with all the info on the quotes. He spoke with Dean after the last meeting who informed him that they are going to upgrade the propane tank behind the youth center to a 1,000-gallon tank. He ran the conduit from the youth center to the grass area. He recommends quote #2 with propane and the annunciator from Gentech for $29,500.00. Councilman Carey asked besides Jim who else looked at this. Councilman Jennings stated Mike Romano. He looked at all these quotes. Supervisor asked if there’s an advantage to propane vs. diesel. Councilman Jennings: no advantage just instead of having it right next to the building – it would be on the other side of the garage and we’d have to run the fuel line. Councilman Howell noted the one quote is different from the original quote given. Councilman Jennings stated that original quote was from July so the # went up. Dean prefers propane. Councilman Howell questioned the crane & placement. Dean added that he needs the cut sheet – the engineering drawings so we can pre-do the pad before winter sets in. The conduit has to be run up through the pad.

MOTION TO APPROVE THE PURCHASE OF GENERATOR WITH AMERICAN RESCUE PLAN RELIEF FUNDS:
MOTION offered Councilman Jennings 2nd Councilman Furman to approve the quote from GENTECH for a Cummins Power RS80, 80KW propane generator with the annunciator for $29,500 of the American relief funds. All in favor: Carey, Howell, Jennings, Volpe, Furman; carried.

HIGHWAY DEPT.:
Supt. Hassenmayer reported that Fall clean-up wrapped up Saturday. There were 40 home pick-ups. It was slower this fall. Spring was high. The auction completed last week. The following were the end offers: $9,500 for a police car; $1,000 for the dump body; $500 PEX piping; $4,050 for a trailer; $180 for the police car roof light; both offers for louvers were rejected.

MOTION TO ACCEPT OFFERS FROM AUCTION BID SITE FOR VARIOUS ITEMS:
MOTION offered Councilman Carey 2nd Councilman Furman to accept the following offers for various items as follows: $9,500 for a police car; $1,000 for the dump body; $500 PEX piping; $4,050 for a trailer; $180 for the police car roof light; both offers for louvers were rejected. All in favor: Carey, Howell, Jennings, Volpe, Furman; carried.

Supt. Hassenmayer reported he is still dealing with insurance with regard to the totaled vacuum truck. He reported the power was cut to the pole in the parking lot. It will be paved Wednesday 10/20/2021. Pingotti paving will be doing part of this along with the highway guys. He is not sure if the 2nd light will be up in time for election night. He asked if the board would be interested in making that whole are over there one way around the building. The board will think about it until the next meeting.

MOTION TO APPROVE HIGHWAY DEPARTMENT BUDGET MODIFICATION:
MOTION offered Councilman Howell 2nd Councilman Carey to approve the following:
Increase B2130 Ref/Garbage Revenue by $463.00 And
Increase B8160.4 Ref/Garbage Contr. $463.00.
(Payment from residents for 2021 fall clean-up.) All in favor: Howell, Jennings, Volpe, Carey, Furman; carried.

Supt. Hassenmayer reported he roughly measured out & got the tonnage of the parking lot. We allowed $50,000 for the job. It’s probably not gonna be ½ that.

POLICE DEPARTMENT:
Deputy Chief Maresca noted the Memorandum of Agreement between OC Sheriff’ & Local & State Police Agencies re: PRE-ARRAIGNMENT DETENTION with the OC Sheriff’s office.

MOTION TO APPROVE POLICE CHIEF TO SIGN MEMORANDUM OF AGREEMENT BETWEEN OC SHERIFF’S OFFICE & LOCAL & STATE POLICE AGENCIES:
MOTION offered Councilman Carey 2nd Councilman Furman TO APPROVE POLICE CHIEF TO SIGN MEMORANDUM OF AGREEMENT BETWEEN OC SHERIFF’S OFFICE & LOCAL & STATE POLICE AGENCIES regarding pre-arraignment detention. All in favor: Howell, Jennings, Volpe, Carey, Furman; carried.

VILLAGE OF OTISVILLE:
Trustee Loeven noted the Halloween curfew to be approved and asked if Kathleen could send a copy to the village clerk. She informed the board that the centennial clock dedication will be on Oct. 21, 2021 at 6:45pm before the village board meeting. The time capsule will be buried late December/early January.

BUILDING DEPARTMENT:
BI Musial reported on the numbers of violations, permits issued, title searches & revenue collected so far this year. (copies on file in town clerk’s office)

DOG CONTROL OFFICER:
Supervisor Volpe stated it was brought up at the last meeting about the town having a DCO & the village having a DCO. David did some research. The state has things written with ‘must’ & ‘may’. The town must have a DCO. The village may have a DCO. It’s based off where the licenses are issued which is the town of Mount Hope, therefore it is an “A” item and needs to stay an “A” item. Everyone received the response from David.

MOTION TO APPROVE SUPERVISOR’S DEPARTMENT BUDGET MODIFICATION:
MOTION offered Councilman Howell 2nd Councilman Furman to approve the following:
Increase revenue A2770 Unclassified revenue by $8,358.20 AND
Increase expense A1620.4 Buildings Contr. by $8,358.20.( re: lightning strike insurance claim reimbursement.)

MOTION TO APPROVE 2021 HALLOWEEN CURFEW:
MOTION offered Councilman Furman 2nd Councilman Howell that anyone under the age of 18 must be off town roads after 9:00pm from October 29, 2021 through October 31, 2021 unless they are accompanied by a parent or guardian 21 years of age or older or if they are coming to or from a work assignment or school activity. All in favor: Howell, Jennings, Volpe, Carey, Furman; carried.

MOTION TO SURPLUS & DESTROY A BROKEN COUCH FROM THE YOUTH CENTER:
MOTION offered Councilman Furman 2nd Councilman Carey to surplus & destroy the broken couch from the youth center as it cannot be repaired. All in favor: Howell, Carey, Jennings, Furman, Volpe; carried.

PUBLIC PARTICIPATION:
Diane Loeven spoke re: DCO. She requested a copy of what the town attorney gave to the board members.

TOWN BOARD COMMENTS:
Councilman Howell spoke re: building department procedural/legal issue. There has to be resolutions and hearings as outlined in the law. Supervisor Volpe explained to Atty. Bill Bavoso that as COVID started we had a house in the town that is unsafe. He believes they are operating a generator inside the house. The building inspector went in the house and then it was an issue with not being able to get a court appearance because of COVID. Long/short of it – it is unsafe and we want to fix whatever the issues are. He was told at one point that the sheriff office could do something then he was told the town board had to do something. There is confusion.
Councilman Jennings wished everyone a Happy Halloween.
Councilman Furman hopes to see everyone out for Halloween.
Councilman Carey spoke re: trunk & treat. He hopes it will be successful. Early voting starts 10-23-2021. He noted for everyone to keep an eye on the library issue.
Councilman Howell spoke re: 5G Telecommunications proposed local law which was recommended by the planning board. He didn’t see any emails other than the recommendation from David. Supervisor Volpe: we can do the public hearing for the next meeting.

MOTION TO SET A PUBLIC HEARING FOR PROPOSED LOCAL LAW #4-2021 ESTABLISHING STANDARDS FOR SMALL CELL WIRELESS FACILITIES IN THE RIGHTS-OF-WAY IN THE TOWN OF MOUNT HOPE:
MOTION offered Councilman Furman 2nd Councilman Carey to schedule a public hearing for PROPOSED LOCAL LAW #4-2021 ESTABLISHING STANDARDS FOR SMALL CELL WIRELESS FACILITIES IN THE RIGHTS-OF-WAY IN THE TOWN OF MOUNT HOPE on November 1, 2021 at 7:30pm in the town hall meeting room. All in favor: Howell, Carey, Jennings, Furman, Volpe; carried.

Councilman Carey reminded everyone about the NARCAN class.

CONDEMNED PROPERTY:
(Attorney Bill Bavoso read through paperwork provided by the building inspector.)
Supervisor Volpe asked the attorney for his opinion.
Mr. Bavoso asked if there was a report form the building inspector that the property is unsafe.
BI Musial: we condemned it.
Bavoso: have you done anything with a public hearing?
Supervisor: no.

Bavoso: the next step would be to set a public hearing on the reason of 94-6 of your statutes so that you can determine…. time and place…at least 5-day notice to the owner having an interest to determine whether the order to repair or remove shall be affirmed or modified or vacated. So, you have to have a hearing before the town board.
Supervisor: I can set that public hearing? Now that it’s been condemned, there’s nothing else that I need to do other than set the public hearing?
Bavoso: correct, the board needs to set the public hearing. Discussion.

MOTION TO SET PUBLIC HEARING ON CONDEMNED PROPERTY LOCATED AT (SBL 10-1-46), 1641 ROUTE 211 WEST:
MOTION offered Councilman Carey 2nd Councilman Furman for the town board to schedule a public hearing on November 1, 2021 at 7:31pm with regard to the property located at 1641 Route 211 West (SBL: 10-1-46) for the purposes of whether the same shall be repaired, removed or demolished based upon the evidence at the public hearing and recommendation of town officials pursuant to 94-6 of the town codes. All in favor: Howell, Carey, Jennings, Volpe, Furman; carried.

Supervisor: Do we send something to the occupants?
Bavoso: yes, you need to get a copy of that. My recommendation, 5-day notice to the owner requires personal services and follow up with certified return receipt.

MOTION FOR ADJOURNMENT:
MOTION offered Councilman Furman 2nd Councilman Howell to adjourn the meeting at 8:10pm. All in favor: Howell, Carey, Jennings, Volpe, Furman; carried.

The next meeting is scheduled for Monday, November 1, 2021at 7:30pm in the town hall meeting room.
