TOWN OF MOUNT HOPE BOARD MEETING, JANUARY 22, 2019

The town board meeting of the Town Board of the Town of Mount Hope was held at Town Hall on January 22, 2019 at 7:30pm with the following present:  Supervisor Chad Volpe, Councilman Matt Howell, Councilman Brian Carey, Councilman Chris Furman & Town Clerk Kathleen Myers. 

NOT PRESENT: Councilman Jim Jennings.

OFFICIALS PRESENT:Highway Supt. Hassenmayer, Town Attorney Bavoso, Deputy Police Chief Maresca.

Supervisor Volpe called the meeting to order at 7:30pm following the Pledge of Allegiance. He reminded everyone to silence/turn off their cell phones.

MOTION TO ACCEPT PRIOR MEETING MINUTES:

MOTION offered Councilman Furman 2nd Councilman Carey that the minutes of the January 7, 2019 meeting as submitted are accepted.  All in favor: Howell, Carey, Volpe, Furman; carried.

COMMITTEE REPORTS:

BOARD REPORTS:

Councilman Howell: no report.

Councilman Careyreported the Little League will forward the insurance information. They will also provide a list of games for Dean. They had previously come to the board for support/help maintain fields. He had with him a suggestion box to be used for the senior center. He would like to get better fitting cards to use for the box. He will install it. He wants to go to senior meeting to talk about an Easter egg hunt.

Councilman Furman: no report.

ZONING LAW:

Attorney Bavoso reported that since last meeting they (he and the consultant) have been working on changes to the zoning law. Those have been made and were minor changes like not banning pigs as part of agriculture. In looking back in the code we are pretty sure those bans were created in the late 70’s when there wasn’t the technology to reduce some of the nuisance. We took some of that stuff out; a few of the other things that the county wanted. There were 2 outstanding issues: one of them was a county comment stating that ‘there should be a reference in the subdivision law for the town that it has to follow the cluster subdivision requirements of the zoning’. He believes it exists.

He looked through the code – Sec. 210-12 which is the portion of the subdivision law which has to do with the review of sketch plans says that “the planning board shall review the sketch plan taking into consideration the requirements of the community in connection with the land being developed & shall include but not be limited to public health safety & welfare. Particular attention should be given to location & width of streets……and the requirements of the town master plan, official map & zoning refers anybody doing a subdivision to those provisions’ – so he thinks we are automatically covered. The other question that came up was structural stability of accessory structures. If people are intending to put solar panels on them – he doesn’t expect we are going to need to make a change to the current law that hasn’t already been made. He believes that’s more a procedural matter in the building department. He wants to check with Julie & see if the town requires a certificate of compliance for accessory structures and if that’s the case then we can build that into whatever their checklist is for someone wanting to do solar. Based on that – he emailed to everybody the updated draft of the zoning law today 100 pages long – he is comfortable with the town board adopting that law this evening.

HIGHWAY DEPARTMENT:

Supt. Hassenmayer reported the windows arrived for the community center. They were working on installing them up until last Thursday. Friday we had some snow activity and over the weekend. Today is too cold to work over there. The gazebo for the new walking trail is here. He had it delivered here due to the soft ground down there. Hopefully when it dries out in the spring – we can get that built. Supervisor Volpe asked him if he could meet Mike Romano at 9:00am tomorrow morning at the community center. The whole building is wired up right now. O&R requires a certain (inaudible) that goes down to the conduit. It’s 7-9 weeks to order it. He involved the engineers-they said this other place may have it. Mike checked with them –same thing 7-9 weeks. Mike is gonna meet with the engineers from O&R tomorrow. He thinks he can create the thing they want himself but it has to be approved by O&R. Supervisor will try to attend as well. Dean will meet him there.

POLICE DEPARTMENT:

Deputy Chief Maresca reported on the 2 officers that were able to apprehend those fugitives from Louisiana last week- Officer Skoufis & Officer Burke did a very good job and thinks they should be recognized.

 

VILLAGE OF OTISVILLE:

Trustee Loeven had no report at this time.

 

AT THIS TIME, Supervisor Volpe notes to everyone that Councilman Jennings is not present due to illness.

 

MOTION TO APPROVE LOCAL LAW #1-2019 ENTITLED “TO REPEAL CHAPTER 193 AND REPLACE CHAPTER 250 OF THE TOWN CODE OF THE TOWN OF MOUNT HOPE:

MOTION offered Councilman Howell 2ndCouncilman Carey to accept & approve the Local Law #1-2019 entitled “To Repeal Chapter 193 and Replace Chapter 250 of the Town Code of the Town of Mount Hope”. All in favor: Howell, Carey, Volpe, Furman; carried.

 

ASSESSOR RE-APPOINTMENT:

Attorney Bavoso explained that by statute it’s a 6 year appointment for the assessor in any municipality in the state. The appointment would be October 1, 2019 through Sept. 30, 2025. The municipalities don’t have any say over the term length – it’s set in municipal law. Supervisor Volpe asked if this appointment had to be done right now. Atty: Any time before Sept. 30thhe can be re-appointed. Councilman Carey would like to wait as he has questions he would like answered. Councilman Howell is okay with waiting. Councilman Furman agreed to wait.

  

CONCRETE BIDS:

Supervisor Volpe asked if everyone had their concrete bids. He explained the original bid they got expired. Supt. Hassenmayer explained the old footings were removed they still need to do the excavating for the new footings.

MOTION TO APPROVE BID FROM DEVRIES CONCRETE:

MOTION offered Councilman Howell 2ndCouncilman Furman to approve DeVries Concrete to do the concrete work at the community center for a total cost of $33,000. All in favor: Howell, Carey, Volpe, Furman; carried.

(At this time, Councilman Carey added that the payment for this work will come from grant money.)

 

MOTION TO ACCEPT RESIGNATION FROM POLICE OFFICER JOHN CHEVALIER:

MOTION offered Councilman Furman 2ndCouncilman Howell to accept the resignation from Police Officer John Chevalier effective February 28, 2019.  All in favor: Howell, Carey, Volpe, Furman; carried.

 

MOTION TO SURPLUS/DESTROY PHILLIPS MAGNAVOX TELEVISION SET:

MOTION offered Councilman Furman 2ndCouncilman Howell to surplus/destroy a Phillips Magnavox television set from the vault as it is no longer in working condition. All in favor: Howell, Carey, Volpe, Furman; carried.

 

SPRAY FOAM INSULATION QUOTES:

Supervisor Volpe explained this had to be re-bid because it was almost a year ago that we did this. We weren’t ready for the spray foam yet. The quote expired. He read from an email from Jason Pitingaro: Foamco requoted for $49,498.00 including the $11,000 for the coating. Foam Boys provided a quote for a total of $37,800 including $7,000 for the coating. They also provided a quote for $53,680 including $7,000 for the coating. All County Insulation provided a quote for $53,229 including $12,442 for the coating. Based on these quotes and what was provided in each, I would recommend utilizing All County at $53,229. This is an additional cost of $3,801 over Foamco but utilizes a better product throughout the project. Councilman Carey added that these quotes are good for 30 days. Councilman Howell added that All County also includes the fire lock barrier on the walls. It is more money for a better product.

 

MOTION TO APPROVE SPRAY FOAM QUOTE FROM ALL COUNTY INSULATION & COATING INC.:

MOTION offered Councilman Howell 2ndCouncilman Carey to accept quote from All County Insulation & Coating INC for $53,229.00 for the (new) community center, which will also be paid out of grant money.  All in favor: Howell, Carey, Volpe, Furman; carried.

 

CLIMB THE GUNKS BIKE RIDE:

Supervisor Volpe explained they do not need roads closed down. They are not looking for anything from the town. They had already sent the insurance information. They go through multiple towns.   

 

MOTION TO APPROVE CLIMB THE GUNKS BIKE RIDE THROUGH MOUNT HOPE:

MOTION offered Councilman Furman 2ndCouncilman Carey to approve the ‘Climb The Gunks’ Bike ride for MS through Mount Hope on Sunday, September 29, 2019. All in favor: Howell, Carey, Volpe, Furman; carried.

(Atty. Bavoso suggested giving the Police Dept. the information so they will be aware on that day.)

 

OTISVILLE COUNTRY FAIR FIREWORKS APPLICATION:

Supervisor Volpe received quite a few things from the Otisville Fair. He noted the fireworks application. Last year we approved it pending the rest of the information being received.

 

MOTION TO APPROVE THE OTISVILLE COUNTRY FAIR FIREWORKS APPLICATION:

MOTION offered Councilman Carey 2ndCouncilman Furman to approve the Otisville Country Fair fireworks application for Sunday, August 11, 2019 fireworks display with the stipulation that the packet must be completed with insurance certificates prior to the event. All in favor: Howell, Carey, Volpe, Furman; carried.

OTISVILLE COUNTRY FAIR PAVILION RENTAL APPLICATION:

Supervisor Volpe asked if Dean had received all the paperwork (from the fair committee). Discussion on request for rental from fair committee. He wanted to clarify the dates with Dean 7-29-19 through 8-18-2019. He will table this until Dean can look at the calendar.

 

OTISVILLE LIONS CLUB EASTER EGG HUNT:

Supervisor Volpe asked board members their thoughts. Councilman Carey wanted to have this tabled because he has some questions for Jim. As far as the letter goes and having the egg hunt for 3 successful years- last year it was cancelled on the Lions Club facebook page on March 23 due to inclement weather. Other towns had it last year. The weather forecast was not correct. He wants to talk to Jim because he knows he is the president of the Lions Club. He would still like to go forward with doing our own town run Easter Egg Hunt.

Supervisor Volpe asked Dean if there was an issue with getting the trailer out of there last year. Supt. Hassenmayer stated yes and in fact all the little league bleachers from the fair are still on the town property by the track.  Supervisor suggested taking a security deposit. We don’t charge them normally for the pavilion. I know there were other events starting and we were still waiting to get the trailer out of there. We would give it back to them providing….you don’t have the manpower, we don’t have the manpower. 

 

RESOLUTION TO AUDIT THE CLAIMS:

MOTION offered Councilman Furman 2nd Councilman Howell to approve the following bills:

MOUNT HOPE FIRE:    #1                    $ 130,725.00.

CONCERT SERIES GRANT:

Supervisor Volpe stated that he has not received any information on the concert series grant yet.

 

PUBLIC PARTICIPATION:

Diane Loevencommented that the statistics for the Hometown Helpers will be emailed. They surpassed the amount of service provided last year. This year – over 1,000 volunteer service. She thanked the clerks. Supervisor Volpe asked about doing an appreciation at one of the board meetings. He spoke of the intake for his mother. A lot of people don’t realize that resource is available. He thinks this is great service.

 

TOWN BOARD COMMENTS:

Councilman Furmangave his email address:  cfurman@townofmounthope.org. He noted that he would have liked to take classes for newly elected officials given by Association of Towns but the cost would be over $1,000. He will wait until next year when he can take them in Albany and stay with his children who live there. For now he will use his town law manual and fellow board members.

Councilman Carey– no comments.

Councilman Howellasked if we have received any response from NYS with regard to bump on Route 211.  Atty. Bavoso has not received any response. Councilman Howell asked about getting a professional cleaning company to come in and clean & preserve the floors at the senior center.

 

MOTION TO ADJOURN:

MOTION offered Councilman Howell 2nd Councilman Carey to adjourn the meeting at 8:07pm.  All in favor: Howell, Carey, Volpe, Furman; carried.

 

The next meeting is scheduled for Monday, February 4, 2019at 7:30pm.
